We have exten­sive expe­ri­ence in all aspects of com­mer­cial and con­tract lit­i­ga­tion and arbitration.

We deal with dis­putes aris­ing in the con­text of a wide range of con­tracts that are com­mon­ly entered into by any com­pa­ny, such as pur­chase and sale agree­ments, (com­mer­cial) lease agree­ments, man­age­ment agree­ments, non-com­pete and exclu­siv­i­ty covenants, ser­vice agree­ments, loan agree­ments, man­u­fac­tur­ing agreements.

Addi­tion­al­ly, we advise clients in con­tentious sit­u­a­tions with regard to dis­tri­b­u­tion, fran­chis­ing or agency contracts. 

An increas­ing part of our prac­tice is ded­i­cat­ed to dis­putes regard­ing IT con­tracts, such as soft­ware devel­op­ment and licens­ing, both for soft­ware com­pa­nies con­front­ed with client com­plaints and pay­ment refusals, as for entre­pre­neurs and com­pa­nies that engage with an IT com­pa­ny to opti­mize their inter­nal process­es and are dis­sat­is­fied with the ser­vice provider’s work.

Coop­er­a­tion agree­ments and joint ven­ture agree­ments between sep­a­rate enti­ties want­i­ng to join forces may also lead to con­flicts. We assist our clients in tack­ling those. 

The team is solu­tion ori­ent­ed. We pro­vide pre-lit­i­­ga­­tion advise, risk man­age­ment, and reg­u­lar­ly assist clients in set­tle­ment nego­ti­a­tions. When­ev­er required, we rep­re­sent our clients before Bel­gian courts and arbi­tral tribunals. 

Rep­re­sen­ta­tive matters
  • Rep­re­sent­ing a world­wide soft­ware provider regard­ing a com­plex lia­bil­i­ty claim sub­mit­ted by a client.
  • Rep­re­sent­ing man­u­fac­tur­ers of var­i­ous kinds of goods (from ani­mal sta­bles, over wood­en plates to large steel con­struc­tions) regard­ing claims or pro­ceed­ings start­ed by dissat­is­fied clients.
  • Rep­re­sent­ing a multi­na­tion­al own­ing a ware­house in Bel­gium regard­ing an indem­ni­ty claim for dam­age inflict­ed to the build­ing put at the dis­pos­al of the con­tract partner.
  • Rep­re­sent­ed an inter­na­tion­al biotech com­pa­ny and its insur­er in suc­cess­ful set­tle­ment nego­ti­a­tions against two sup­pli­ers and their insur­ers, obtain­ing a mul­ti-mil­lion euro set­tle­ment to the ben­e­fit of our client as well as pre­serv­ing the client’s com­mer­cial rela­tion­ship with its suppliers.
  • Rep­re­sent­ing a lender in pro­ceed­ings ini­ti­at­ed by the guar­an­tor of notar­i­al loan agree­ments against the execu­to­ry seizure of the shares of a hold­ing owned by the guarantor.
  • Assist­ing var­i­ous com­pa­nies and con­sul­tants regard­ing non-com­pete claus­es in ser­vice agree­ments, and nego­ti­at­ing set­tle­ment agreements.
  • Assist­ing and rep­re­sent­ing a lead­ing Bel­gian real estate own­er and prop­er­ty man­ag­er on mul­ti­ple dis­putes (incl. com­mer­cial lease).
  • Obtain­ing the favor­able set­tle­ment agree­ment on behalf of a fran­chisee with the fran­chisor, a Bel­gian tex­tile dis­trib­u­tor, after an acqui­si­tion of the fran­chisor by a for­eign tex­tile group.
