Insolvency

We serve par­ties con­front­ed with insol­ven­cy pro­ceed­ings or bank­rupt­cy of its debtors, be it a sup­pli­er, a client, or any oth­er third par­ty, to gath­er options and under­take actions aimed at max­i­miz­ing debt recovery. 

We also pro­vide assis­tance to com­pa­nies and their stake­hold­ers in insol­ven­cy sit­u­a­tions. This includes con­sid­er­ing and exe­cut­ing dif­fer­ent solu­tions, such as dis­so­lu­tion of a com­pa­ny, bank­rupt­cy, an asset or share deal, or judi­cial reorganization. 

Assis­tance to clients want­i­ng to acquire assets from a (com­pet­ing) com­pa­ny in insol­ven­cy pro­ceed­ings is part of the team’s expertise. 

Rep­re­sen­ta­tive matters
  • Advised a large Bel­gian hotel group in its attempt to acquire sev­er­al assets of anoth­er hotel own­er, under the pro­vi­sions of the Bel­gian Act on the con­ti­nu­ity of enterprises.
  • Assist­ed mul­ti­ple com­pa­nies in the fol­low up of judi­cial reor­ga­ni­za­tion pro­ceed­ings of debtors.
  • Assist­ed a com­pa­ny in orga­niz­ing its defense against a claim lodged by a share­hold­er and lender to have the com­pa­ny declared bank­rupt, and asso­ci­at­ed nego­ti­a­tions on set­tle­ment of out­stand­ing debts. 
  • Con­duct nego­ti­a­tions with receivers of bank­rupt­cies to acquire assets, and/​or to enforce the clients (legal) secu­ri­ties in order to obtain a pay-out. 
  • Pro­vid­ing advice and guid­ance to the founder of a start-up to file for bank­rupt­cy, after unsuc­cess­ful attempts to obtain addi­tion­al funding.
